Scope of These Terms
These Terms of Service govern your use of the consumer version of WordFlow — the version individuals download and use on their own, with billing through the Apple App Store, Google Play Store, or Stripe.
If you are a school, school district, teacher, or student using WordFlow through an agreement with your school or district, these terms do not apply to you. Your use is governed by the separate School Service Agreement and Data Privacy Agreement between Moonslide Inc. and your school or district. See the WordFlow School Privacy Policy for more.
1. Acceptance of Terms
By accessing or using the WordFlow application provided by Moonslide Inc. ("WordFlow," "we," "us," or the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use the consumer version of WordFlow. If you are between 13 and the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
WordFlow is a vocabulary learning platform that uses adaptive technology to identify words a user is likely to find difficult and deliver personalized vocabulary instruction based on books and other reading material the user selects. We may add, remove, or change features of the Service at our discretion.
3. Registration and Account Security
To use most features, you must create an account. You agree to provide accurate and complete information and to keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use.
We may refuse, suspend, or terminate any account at our discretion, including for inactivity or for any breach of these Terms.
4. Email Communications
When you register, you will be enrolled in WordFlow newsletters and promotional emails. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at [email protected]. We will also send transactional emails (account, billing, security) that are not subject to opt-out while you maintain an account.
If you reside in a jurisdiction that requires affirmative opt-in for marketing communications (for example, the EU or UK under GDPR), you will be presented with a separate opt-in choice at signup, and we will only send you marketing communications if you affirmatively opt in.
5. Acceptable Use
You agree not to misuse the Service. You will not:
  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload, share, or transmit content that is unlawful, infringing, defamatory, harassing, abusive, hateful, or sexually explicit.
  • Attempt to gain unauthorized access to any part of the Service, other user accounts, or our systems.
  • Interfere with or disrupt the Service, its servers, or networks.
  • Use any robot, scraper, crawler, or other automated means to access or collect data from the Service without our prior written consent.
  • Reverse engineer, decompile, or disassemble any part of the Service, except where applicable law expressly permits it.
  • Use the Service to train, evaluate, or improve any machine learning or AI model without our prior written consent.
  • Resell, sublicense, or commercially exploit access to the Service.
6. License
Subject to your compliance with these Terms, Moonslide Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial vocabulary learning. All other rights are reserved.
7. Intellectual Property
The Service, including all software, content, design, text, graphics, logos, vocabulary data, and the WordFlow trademark, is owned by Moonslide Inc. and is protected by U.S. and international copyright, trademark, patent, and trade secret laws. Nothing in these Terms transfers any ownership rights to you.
Third-party content (such as book text or excerpts) accessed through the Service remains the property of its respective owners and is used under license or fair use.
8. User Feedback
If you send us suggestions, ideas, or feedback about the Service, you grant Moonslide Inc. a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, with no obligation to compensate you.
9. Payments, Subscriptions, and Refunds
Some features require a paid subscription.
  • Stripe billing: Payments made directly through WordFlow are processed by Stripe. Moonslide Inc. does not store credit card details.
  • App Store and Google Play billing: If you subscribe through the Apple App Store or Google Play Store, payment, renewal, cancellation, and refunds are handled by Apple or Google under their respective terms.
  • Auto-renewal: Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings or, for in-app purchases, through your Apple or Google account.
  • Refunds: Except where required by law, fees are non-refundable. Refund requests for in-app purchases must be made to Apple or Google.
  • Taxes: You are responsible for any applicable taxes.
  • Price changes: We may change prices at any time. Changes will not affect a billing period already paid; we will give reasonable notice before any renewal at a new price.
10. Apple App Store and Google Play Terms
If you download WordFlow from the Apple App Store, you acknowledge and agree that:
  • These Terms are between you and Moonslide Inc. only, not with Apple. Apple is not responsible for the Service or its content.
  • Your use of WordFlow must comply with the Apple App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the Service.
  • In the event of any failure of WordFlow to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing claims by you or any third party relating to WordFlow.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you download WordFlow from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not responsible for the Service.
11. Third-Party Services
WordFlow integrates with third-party services (including Stripe for payments and analytics providers). Your use of those services is governed by their own terms and privacy policies. Moonslide Inc. is not responsible for third-party services.
12. Children
The consumer version of WordFlow is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in this channel. Children under 13 should use WordFlow only through a school or district that has entered into a school agreement with Moonslide Inc.
13. Termination
You may stop using the Service at any time and may delete your account by contacting [email protected]. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including any violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, dispute resolution, and governing law) will survive.
14. Modifications to the Service
Moonslide Inc. may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, MOONSLIDE INC. DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL PRODUCE ANY PARTICULAR LEARNING OUTCOME. YOU USE THE SERVICE AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so portions of the above may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MOONSLIDE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY EVENT, MOONSLIDE INC.'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID MOONSLIDE INC. FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation of certain damages, so portions of the above may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Moonslide Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
18. Dispute Resolution; Binding Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
  • Informal Resolution: Before filing any claim, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least 60 days.
  • Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.
  • Class-Action Waiver: You and Moonslide Inc. each agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.
  • Exceptions: Either party may bring an individual action in small claims court. Either party may also seek injunctive or equitable relief in court to protect its intellectual property rights.
  • Opt-Out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
  • Severability: If the class-action waiver is found unenforceable, the remainder of this section will likewise be unenforceable, and the dispute will be resolved in court under Section 19.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. To the extent any dispute is not subject to arbitration under Section 18, the parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
20. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email and update the "Last Revised" date above. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
21. Miscellaneous
These Terms, together with the Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Moonslide Inc. regarding the consumer version of the Service. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship.
